FEE POLICY

Refundable security deposit

A refundable security deposit of up to ₹4,000 will be charged at the time of booking, though this amount may be lower during limited-period promotional offers. Any deductions for extra kilometers driven (charged at ₹8/KM), fuel shortages, traffic challans, or damages will be adjusted from this amount. The final balance will be standard refunded within 10 days of the booking's end time; however, for faster processing within 4 days, please select the "Refund to Bank Account" option and provide your account details while making your payment.

  • Extra Kilometer Charges: If you exceed the allocated kilometer limit of your chosen plan, an extra charge of ₹8 per KM will be applicable. This amount will be calculated automatically at the end of your trip and will be deducted from your refundable security deposit.

  • Extended Duration: If you keep the vehicle beyond 24 hours, extra hours are capped under standard slabs (up to 12 extra hours will be charged at a fixed rate of ₹1,800, and exceeding 12 extra hours will count as a full next-day charge).

  • Other Exclusions: Fuel costs, tolls, parking fees, and inter-state taxes are strictly excluded from the rental plan and must be paid by the customer during the trip.

  • No Reimbursement for Excess Fuel: If you return the car with more fuel than what was provided at the start of the trip, no refunds or fuel reimbursements will be made for the extra fuel left in the tank. We highly recommend refueling only as much as required for your journey.

  • Under-Refueling Charges: If the vehicle is returned with less fuel than the initial handover level, the cost of the missing fuel plus a standard refueling service charge will be calculated and deducted directly from your refundable security deposit.

    • Changes Free of Cost: Any modification (changing pickup date, time, or car model) requested 24 hours before the trip starts will be done Free of Cost, subject to vehicle availability.

    • Last-Minute Modifications: Any modification requested within 24 hours of the pickup time may attract a modification fee or might be treated as a cancellation, depending on vehicle availability.

    • Rate Adjustments: If you modify your trip dates and the new dates fall on weekends or peak holiday seasons, the revised daily rental rates will apply, and the difference must be paid by the customer.

  • Late Return Penalty: Returning the car late disrupts the next customer's booking. A grace period of 30 minutes is allowed. Beyond this, a penalty of ₹300 per hour plus the hourly rental charges will be applicable. If the vehicle is delayed by more than 6 hours without prior notice, a full next-day rental charge + a dynamic penalty will be imposed.

  • Overspeeding Violation: For your safety and the longevity of our cars, the maximum speed limit is capped at 100 KM/H (or as per government road signs). Exceeding this limit will attract an overspeeding fine of ₹1,000 per violation/alert generated by our GPS tracking system.

  • Deep Cleaning / Coarse Dirt Fee: If the vehicle is returned with stained interiors, mud, pet hair, bad odor, or excessive dirt inside/outside, a professional deep-cleaning fee ranging from ₹500 to ₹1,500 will be charged.

  • Smoking & Alcohol Consumption: Smoking or consuming alcohol inside the vehicle is strictly prohibited. A flat penalty of ₹2,000 will be charged if any signs of smoking (ash, burn marks, or smell) or liquor bottles are found inside the car.

    Delay in taking Car Delivery

    After that, ₹50 for every 15 mins of delay will be charged.

    Late Vehicle Return

     

    (Beyond the booked drop-off time)

    30 minutes grace period allowed.

     

    Post that, ₹300 per hour plus the applicable hourly rental charges will be levied.

    Over-Speeding

     

    (Exceeding the 100 KM/H limit)

    ₹1,000 for every speed alert generated by our GPS tracking system. Repeated infractions after a warning will lead to immediate withdrawal of services.

    Not Refuelling

     

    (Returning car at a lower fuel level)

    ₹500 flat refuelling service charge + the actual fuel cost required to bring the tank back to the initial level.

    Traffic / Parking Violations

     

    (Challans incurred during your trip)

    Full payment of fines/late fees (even if received after the booking ends) + a ₹200 convenience fee.
    Interior Cleaning Required

    Minor cleaning: ₹500

     

    Major cleaning/Deep stains: ₹1,500

    Smoking & Alcohol Consumption₹2,000 flat penalty plus applicable damage costs related to interior burns, ash, or bad odor.

Privacy Notice

Though we make every effort to preserve the user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with an appropriate law enforcement investigation, current judicial proceeding, a court order or legal process served on our Site, or as required by law. We may also need to disclose the personal information to a third party for the purpose of delivery of the services to the users.

General Description

The Site may collect a user's name, postal address, telephone number, mobile number, e-mail address. Besides the above, Members intending to create an account or book a vehicle may be asked to submit personal information including driving license, proof of identity etc., besides information pertaining to the Member’s credit card/debit card or bank account details. The Site may also be required to collect the PAN card details and any such detail which is relevant to carry out the transaction. This information is requested if the user is entering into a transaction and is further used to deliver the services as has been requested by the user. The data so collected from the user shall also be used to manage the Site, and detect any fraud or site abuses.

Other personal information that we collect includes the following:

  • Vehicle Use Data: Vehicles will contain hardware (such as GPS trackers) that gathers and transmits information about vehicle use. This is done as a security measure against accidents or theft and also to provide you with valuable services and information.

  • Location Tracking: To prevent theft, and to allow us to locate you in case of emergency, accident, lock-out, etc., we track the location of your vehicle. Your location information will be confined to Tripzoo service, and we will never impermissibly make your location or movements public. As part of our service, the location of your vehicle may be released to insurance companies, the police, or similar parties in the course of an investigation and/or accident claim, and to provide assistance in emergencies. Information regarding the location of each vehicle on Tripzoo’s site is also transmitted to Tripzoo and can be tracked accordingly.

  • Driver and Vehicle Information: As a customer of Tripzoo’s Site, you authorize us to access your driver’s record, vehicle history report from all applicable entities and authorities. This authorization continues for as long as you are a Tripzoo customer. Moreover, you authorize all DMVs, RTOs, auto mechanics and all other entities and interested parties to release information to us regarding your driving record and vehicle history.

You have the right to request that Tripzoo discontinue the use of your personal information. To withdraw your consent to our collection and processing of your information at any time, you may do so by closing your account or writing to us.

Collection and Use of Non-Personal Information

We also collect non-personal information – data in a form that does not permit direct association with any specific individual, including IP addresses, usage details and identifying technologies. We may use, transfer, collect and disclose non-personal information for any purpose. If we do combine non-personal information with personal information, the combined information will be treated as personal information for as long as it remains combined.

Communication Consent (TRAI Compliance)

In compliance with Telecom Regulatory Authority of India (TRAI) guidelines, you authorize Tripzoo and its affiliates/partners, or any other entities associated with Tripzoo, to communicate with you through telephone, mobile, email, SMS, WhatsApp, or other communication modes (both current and future). This consent is applicable even if your number is registered in the National Do Not Call Registry (NDNC) or on www.nccptrai.gov.in.

Security

The Site’s primary goal in collecting personal information is to provide you, the member, with a potentially fulfilling experience. The information collected by the Site is protected by the use of appropriate technical and security measures to prevent unauthorized or unlawful access to or accidental loss of or destruction or damage to your information.

It is however expressly clarified that Tripzoo will not be responsible for any third-party access to information provided by you on the Site arising as a result of any unauthorized access, hacking, or misuse beyond our reasonable control.

1. Definitions and Interpretations

Definitions

Unless the context otherwise requires, the following capitalized words as used in these Terms shall have the meaning as respectively assigned to such terms hereunder:

  • Applicable Laws” shall mean and include, all applicable statutes, enactments, acts of legislature or the Parliament, laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives and orders of any Governmental Authority, tribunal, board, court or a recognised stock exchange of India.

  • “Governmental Authority” means any governmental or statutory authority, government department, agency, commission, board, tribunal, court or other entity, authority or body authorized to exercise legislative, judicial, regulatory or administrative functions of, or pertaining to, a government or any state or other subdivision thereof or any municipality, district or other subdivision thereof having jurisdiction pursuant to Applicable Laws.

  • “User” / "Customer" shall mean any person who has formally enrolled to use Tripzoo’s vehicles and/or services, pursuant to the completion of usage formalities and acceptance of the terms and conditions as set out herein. (There is no difference between User & Customer. User is a person who registered with tripzoo.in and customer is a person who hired the vehicle).

  • “Tripzoo Vehicle” shall mean a vehicle provided by Tripzoo for rental to its Users on the terms and conditions as set out herein, including a vehicle owned and provided by Tripzoo’s fleet partners if applicable.

  • “Scheme” shall mean the Tripzoo car-club scheme as floated by Tripzoo pursuant to which the Tripzoo Vehicles are provided to Users for self-drive purpose.

  • “Terms” shall mean these terms and conditions as may be updated, altered, modified, novated, substituted or replaced from time to time.

Interpretations

  • Words denoting the singular include the plural and vice versa; words denoting a particular gender include all other genders.

  • The headings are inserted for convenience only and shall not affect the construction or interpretation of these Terms.

  • References to rupees (Rs. / ₹) are to the lawful currency of India.

2. User Acknowledgement & Eligibility

Upon accepting the terms and conditions, the User agrees and acknowledges that:

  • Tripzoo has established a website having the registered domain address as www.tripzoo.in (“Website”) where the terms and conditions have been displayed. It is the responsibility of the user to obtain a soft copy of the agreement if they are unable to view or access it on the website or mobile applications.

  • Tripzoo reserves the right to change the terms of this Agreement from time to time with the provision of notice to the User, which shall be considered given when these terms are updated on the Website or iOS / Android apps.

Eligibility Criteria

Any person desirous of enrolling as a User with Tripzoo must satisfy the following criteria:

  • Must be a minimum of 21 years of age.

  • Must be an Indian citizen and must possess a valid Light Motor Vehicle (Non-Transport) Indian driving license at least 6 months old.

  • Must have a good driving record and should not have been found guilty of any offence involving moral turpitude or any offence under the Motor Vehicles Act for which imprisonment for more than 6 months has been prescribed.

Enrollment Formalities

The User shall be required to provide the following documents to Tripzoo’s representatives:

  • A valid original government ID (Aadhar or Passport) and an original hard copy or a DigiLocker version of a valid driving license. (Note: Driving license printed on an A4 sheet of paper will not be considered a valid document).

  • Credit / Debit card or payment details.

  • Tripzoo reserves the right to refuse acceptance of any person as a User without assigning any reason thereto.

3. Booking & Cancellation

  • At the time of booking via the Website, the User must select the vehicle, provide start/end dates and times, specify delivery/return addresses, and pay the required fees.

  • Extensions: If a User wishes to extend a reservation, they must request it prior to the scheduled return time. Tripzoo holds sole discretion to allow or refuse extensions based on vehicle availability and advance payment.

4. Prohibited Use of Tripzoo Vehicles

Users shall not use Tripzoo Vehicles under the following conditions. Any violation may result in immediate termination of service and financial penalties:

  • For any speed race, competition, towing, or propelling any other vehicle.

  • For commercial passenger transportation or operating a taxi service.

  • Driving under the influence of alcohol, drugs, or any intoxicating medication.

  • For the commission of any crime or unlawful activity.

  • Driving outside the territorial boundaries of India, or into prohibited areas (including but not limited to the Leh/Ladakh region and Kaza/Nako region).

  • Driving while using a mobile phone or mobile communication device.

  • Transportation of hazardous, flammable, poisonous goods, or animals.

  • Smoking, burning incense, or consuming tobacco/drugs inside the vehicle is strictly prohibited.

5. Vehicle Pick-Up, Return & Control

  • Remote Access & GPS: All Tripzoo vehicles are fitted with GPS trackers, speed trackers, and remote immobilization systems. In the event of a breach of terms, Tripzoo can exercise controls and shut down the vehicle via remote access.

  • Inspection: Prior to taking possession, the User must do an exterior walk-around and interior look-over, and immediately notify Tripzoo of any existing damages or abnormalities.

  • Keys & Return: The User must return the vehicle secured, clean, and in good working order to the designated location by the end time of the reservation. If the vehicle key, key fob, or parking/toll pass is lost or not returned, late fees and replacement costs will apply.

  • Stolen Vehicles: Any theft of the vehicle or its parts must be reported immediately by the User to the nearest police station via a written complaint, and a copy of the acknowledged FIR/complaint must be shared with Tripzoo.

6. Traffic Violations & Fines

  • All traffic violations, parking fines, toll penalties, or red-light jumps incurred during the rental period are 100% the responsibility of the User.

  • If Tripzoo receives a violation notice from the authorities after the booking has ended, the User remains liable to clear the full payment along with any applicable administrative/convenience fees.

7. Payments, Suspensions & Data Protection

  • Default Interest: In the event the User defaults on any payments due, Tripzoo is entitled to charge the remaining fees along with a default interest rate of 24% per annum.

  • Data Privacy: Tripzoo captures, stores, and processes the Customer’s personal data (including vehicle usage and location tracking metrics) for operational, security, and fraud prevention purposes, strictly adhering to Applicable Laws and our Privacy Policy.

8. Dispute Resolution & Governing Law

  • Arbitration: Any dispute, controversy, or question arising out of or in connection with these Terms shall be referred to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitral tribunal shall comprise a sole arbitrator appointed by Tripzoo, and the decision shall be final and binding.

  • Language & Seat: The arbitration proceedings shall be conducted in the English language, and the seat of arbitration shall be in New Delhi.

  • Governing Law: These Terms shall be governed by and construed in accordance with the substantive laws of India. The courts in New Delhi shall have exclusive jurisdiction over all matters pertaining to this Agreement.

9. Severability & Entire Agreement

  • Severability: If any term, provision, covenant, or condition of this Agreement is held invalid or unenforceable for any reason, the remainder of the provisions will continue in full force and effect as if these Terms had been executed with the invalid portion eliminated. The parties shall substitute for the invalid provision a valid provision that most closely approximates the intent and economic effect of the invalid provision.

  • No Reliance: The Customer represents that he or she has not relied on any representation, assertion, guarantee, warranty, collateral contract, or other assurance, except those set out in these Terms, made by or on behalf of any other party or any other person or entity whatsoever, prior to the execution of this Agreement.

10. Waiver & Assignment

  • Waiver: Failure to exercise and delay in the exercise of any right, power, or privilege hereunder by Tripzoo shall not operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof or the exercise of any other right, power, or privilege. The rights and remedies provided in these Terms are cumulative and not exclusive of any rights or remedies otherwise provided by Applicable Law.

  • Assignment or Transfer: The rights granted to the User under these Terms are purely personal and are not assignable or transferable, in whole or part, to any third party. Any attempt to transfer any rights without the written consent of Tripzoo shall be void and shall have no force and effect. Tripzoo shall have the sole authority to assign this Agreement to an affiliate or to another entity in connection with any corporate restructuring or transaction.

11. Cookies & Third-Party Links

  • Cookies & Web Beacons: Tripzoo uses various technologies, including “cookies” and web beacons, to collect non-identifiable information to enhance our Services. Users may control the effect of cookies through their browser settings; however, some features of Tripzoo’s Service may not work properly if the use of cookies is disabled.

  • Links to Third-Party Websites: Tripzoo’s website may contain links to third-party websites, products, and services. Information collected by third parties, which may include location data or contact details, is governed strictly by the privacy practices of those respective third parties. Tripzoo encourages its Users to learn about the privacy practices of those third parties.

12. Information Security & User Responsibility

  • Data Safeguards: Tripzoo takes necessary precautions – including administrative, technical, and physical measures – to safeguard its Users' personal information against loss, misuse, theft, destruction, alteration, disclosure, and unauthorized access, but does not guarantee the complete, absolute security of such personal Information.

  • Account Confidentiality: The User shall be held completely responsible for maintaining the confidentiality of their account credentials and password. Every User agrees to accept full responsibility for all bookings and activities that occur under his/her account or password.

    • “Website” shall mean www.tripzoo.in along with its official iOS and Android mobile applications.

    In these Terms, except where the context requires otherwise, these Terms will be interpreted as follows:

    • Words denoting the singular include the plural and vice versa; words denoting a particular gender include all other genders.

    • The headings are inserted for convenience only and shall not affect the interpretation of any provision.

    • References to any document (including these Terms) include all future amendments, consolidations, or replacements.

    • References to rupees (Rs. / ₹) are to the lawful currency of India.

    • The words “include” and “including” will be read without limitation.

    • The rule of construction that a contract should be interpreted against the party responsible for the drafting shall not apply.

    2. User Acknowledgement and Acceptance

    Upon accepting these terms and conditions, the User agrees and acknowledges that:

    • Tripzoo has displayed the terms and conditions of FMS on www.tripzoo.in. It is the responsibility of the user to ask representatives of Tripzoo and obtain a soft copy of the agreement if they are unable to view or access the terms on the website/mobile applications.

    • The User has read, understood, and agrees to be bound by these terms, including the fee schedule, privacy policy, and confidentiality terms.

    • Tripzoo reserves the right to change the terms of this Agreement from time to time. Notice shall be considered given when updated on the Website or apps. The amended terms shall be effective and binding on the date of posting.

    • If the User does not accept any term or subsequent amendment, they are not authorized to use any services provided by Tripzoo. Continued use of services signifies absolute acceptance of all terms.

    3. Enrollment & Documentation

    • By accepting these Terms, the User agrees to enroll under the Scheme to avail the FMS facility.

    • The User cannot challenge any provisions on the premise that they have not read or understood the enrollment formalities or terms.

    • Enrollment Formalities: The User must provide necessary particulars and documents to Tripzoo’s representatives, including:

      1. Credit / Debit card details (if selected as the preferred payment mode).

      2. Vehicle details (such as vehicle registration number) for which the fleet management services are required (if not already available in our records).

      3. Any other KYC or verification documents as notified by Tripzoo from time to time.

    • Tripzoo reserves the absolute right to refuse acceptance of any person as a User without assigning any reason whatsoever.

    4. Availing of Services & Scope

    Booking Process

    At the time of booking on the website/app, the User must:

    1. Select the required services.

    2. Provide the start and end date/period for the services.

    3. Provide vehicle details (if not already available in records).

    4. Pay the applicable Fees in advance through the active payment modes.

    Extension of Services

    If a User wishes to extend the duration of FMS, they must communicate the request to Tripzoo prior to the timeline outlined in the Fee Policy. Tripzoo holds sole discretion to allow or refuse the extension. Extensions are subject to vehicle/service feasibility and advance payment for the extended period.

    Scope of Services Provided by Tripzoo

    Upon advance payment, Tripzoo is responsible for:

    • Providing a pick-and-drop facility to the User, if requested and applicable.

    • Ensuring the vehicle subject to FMS is well-maintained as per the prescribed schedule of automotive OEMs.

    • Breakdown Support: In the event of a vehicle breakdown, if it is clearly established that it was due to a mechanical/electrical failure (and not due to user driving behavior or negligence), Tripzoo will provide the best possible resolution, vehicle maintenance, and cleaning services.

    5. Roadside Assistance & Traffic Violations

    • Roadside Assistance: Tripzoo makes reasonable best efforts to provide roadside assistance support. However, if the need arises from a breach of these Terms, the User will be charged for the full costs of the service.

    • Traffic Violations: The User shall be solely liable for all costs, fines, and processing fees arising from traffic violations (including but not limited to parking, speeding, red-light jumping, photo enforcement, and toll violations). The User must pay the fine directly to the concerned authority and provide Tripzoo with proof of payment immediately.

    6. Payments and Liability Policy

    Payment Terms

    • Service Fees must be paid at the time of making the selection on Tripzoo's web platform.

    • Payments can be made via credit/debit card or net banking. The User must ensure the account has sufficient funds. The User is responsible for any bank charges or declined transaction fees.

    • In case of default on payments, Tripzoo is entitled to charge the remaining fees along with a default interest rate of 24% per annum. Tripzoo may engage third-party recovery agencies and reports delays to credit rating agencies.

    • Tripzoo reserves the right to block subsequent purchases until all outstanding dues are cleared.

    Liability Protection & Exclusions

    • Subject to compliance, Tripzoo provides primary liability protection under FMS, limited to the claims covered by the vehicle insurance policy.

    • The User is responsible for any associated deductible charges or losses exceeding the insurance coverage.

    • Liability protection strictly excludes claims made by the User himself, immediate family members, or passengers present in the vehicle at the time of the incident.

    • Tripzoo is not responsible for any damage, loss, or theft of personal property belonging to the User or third parties, regardless of fault or negligence.

    • Under no circumstances will Tripzoo be liable for indirect, incidental, or consequential damages.

    7. Indemnification and Penalty

    • User Indemnification: The User agrees to indemnify, defend, and hold Tripzoo, its parent company, affiliates, directors, officers, employees, and agents harmless from all losses, liabilities, damages, claims, costs, legal fees, and expenses arising out of a breach of these Terms by the User.

    • Penalty: Any violation of Applicable Laws, terms of this agreement, or guidelines setup by Tripzoo will lead to strict legal action, and the User shall be liable for all damages, liabilities, and fines as mentioned in the Fee Policy.

    8. Data Protection & Privacy

    • Data Processing: Tripzoo captures, stores, processes, and uses the Customer’s personal data (including usage and vehicle data) to the extent necessary for the implementation of this Agreement.

    • Communication Consent: By accessing the website or using our services, you explicitly consent to receive communications via phone calls, SMS, email, WhatsApp, and other modes from Tripzoo, even if your number is registered under the National Do Not Call Registry (NDNC) or TRAI commercial registries.

    • Third-Party Disclosures: Tripzoo is authorized to share personal data with third-party service providers, parent companies, or affiliates to fulfill user requirements, provide customized offers, or individual services.

    • Legal Compliance: Tripzoo maintains reasonable safety measures for protecting data but shall disclose user information to any government or regulatory body if required by law or directive. Please read our complete Privacy Policy on the website for deeper details.

    9. Dispute Resolution & Governing Law

    • Arbitration: Any dispute, controversy, or question arising out of or relating to these Terms shall be referred to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

    • Tribunal: The arbitral tribunal shall comprise a sole arbitrator appointed by Tripzoo, whose decision shall be final and binding.

    • Language & Seat: The proceedings shall be conducted in English. The seat and venue of arbitration shall be New Delhi.

    • Governing Law & Jurisdiction: These Terms shall be governed by the laws of India. The courts in New Delhi shall have exclusive jurisdiction over all matters pertaining to this Agreement.

    • Cooperation: The User must not aid or encourage third-party claims against Tripzoo and must cooperate fully with Tripzoo and its insurers during investigations. The User must immediately deliver to Tripzoo any legal summons, notice, or complaint received regarding an accident or theft.

    10. Legal Standard Clauses

    • Severability: If any provision of this Agreement is held invalid or unenforceable, the remainder of the provisions will continue in full force and effect. The parties shall substitute the invalid provision with a valid one that closely matches the original economic intent.

    • Entire Agreement: The Customer represents that he or she has not relied on any prior external representations, guarantees, or collateral contracts except those expressly set out in these Terms.

    • Waiver: Any delay or failure by Tripzoo to exercise its rights or powers under these Terms does not operate as a waiver. The remedies provided are cumulative and not exclusive of rights provided by Applicable Law.

    • Assignment: The rights granted to the User are purely personal and not assignable or transferable to any third party. Any unauthorized transfer shall be void. Tripzoo holds the sole authority to assign this Agreement to an affiliate or another entity during any corporate restructuring or transaction.

    11. Cookies and Web Identifiers

    • Cookies: Tripzoo and its third-party vendors use cookies and web beacons to collect non-identifiable info to enhance our platform.

    • Users can disable cookies through browser settings; however, certain features of Tripzoo's services might stop functioning optimally.

    • Web beacons will still detect page visits if cookies are disabled, but their data will be disregarded and cannot be associated with other cookie parameters.
